We use reasonable efforts to see that all information, identifying and otherwise, submitted to us by users remains private and is used only for the purposes for which you submit it to us and as set forth in this website privacy policy (“Policy”). What information do we collect, and how?

Job applicants: When you seek a job through the Website, you fill out an application online or in our offices. We collect what you submit in connection with your job search; it varies with what you choose to include on your application or resume. Your contact information may be used for marketing such as email campaigns or print material. It usually includes some or all of:

  • Your name, address, e-mail address, and telephone number
  • The industries, disciplines, and geographic areas you’re interested in
  • Your job objective
  • Application/resume details — employment, education, interests, and skills such as languages

Employees: Once you work for us and communicate through the Website, we collect information tied to your job assignments, including:

  • Your availability for work
  • Acceptance of assignments
  • Your hours worked
  • How you want to be paid

Clients: When you communicate through the Website as a client, we collect the information you submit, including:

  • Your name, address, e-mail address, and telephone/fax numbers
  • Your EIN/Federal Tax ID number
  • The types of services you’re interested in obtaining
  • Specifics of job orders placed online
  • Approval of hours worked by temporaries assigned to your company

Because of how World Wide Web communication standards work, when you arrive at or leave the Website we automatically receive the web addresses of the site you came from or are going to. We may also collect which pages you visit, your browser and device type, your IP address, and how many times you access the Website. This is called “Website Traffic Information.”

How do we use the information?

For applicants, we make the information you submit (except Website Traffic Information), including your resume, available to prospective employers and others for the primary purpose for which it was collected — assisting you with your application and job search. For clients, we may use your name, address, e-mail, or other submitted information to contact you about fulfilling your needs for temporary or permanent employees.

TemPositions does not share personally identifiable information (“PII”) with nonaffiliated third parties other than for the primary purpose for which it was collected, except with your express permission or in these limited circumstances:

  • To cooperate in good faith with investigations of fraud or illegal activity, or violations of the Website’s Terms of Use — which may include giving a person’s contact information to interested parties who request it.
  • In response to a subpoena, warrant, court order, levy, attachment, order of a court-appointed receiver, or comparable legal process, including subpoenas from private parties in a civil action.
  • To your agent or legal representative (such as a power-of-attorney holder or an appointed guardian).
  • As aggregated, non-personal statistical data shared for public relations, marketing, or other purposes — never tied to PII.

TemPositions may use Website Traffic Information to understand your preferences and manage server load, improving our service and your experience. We may compile non-personal statistical information from it to assist our marketing efforts.

If all, substantially all, or part of TemPositions’ business were sold, transferred, or disposed of (by legal proceedings, merger, or otherwise), user information including PII may become available to the purchaser or transferee and would be subject to its privacy policies, which may differ from this Policy.

Security

To prevent unauthorized access, maintain data accuracy, and ensure the correct use of information, we have put appropriate physical, electronic, and managerial procedures in place to safeguard and secure the information we collect online. Please note that no transmission over the Internet can be 100% secure. TemPositions also protects user information offline: your information is housed in secure, access-restricted areas, and only employees who need it to perform specific functions are granted access to PII.

Although TemPositions will use reasonable efforts to provide the foregoing security features and to treat all data in accordance with the policies set forth herein, as with virtually any computer system there can be no absolute assurance that security breaches will not occur, and TemPositions hereby disclaims any liability whatsoever for any such security breaches.

Use of cookies

Cookies are small data files sent to your computer to let the Website recognize you through your IP address if you return using the same computer and browser, or for other reasons. This Website uses cookies for those purposes, but not to record PII. Setting your browser to disable or disallow cookies may prevent or inhibit your full use of the Website.

CCPA Employee Privacy Notice

Effective date: January 1, 2020

This CCPA Employee Privacy Notice sets forth our privacy practices as required by the California Consumer Privacy Act (CCPA). It applies only to TemPositions employment-related individuals residing in California who are considered “consumers” under the CCPA — namely job/employee applicants, employees, and contract employees (“contractors”) of TemPositions. We adopt this notice to comply with the CCPA of 2018 and other California privacy laws; any terms defined in the CCPA have the same meaning here.

Overview

The CCPA requires companies to inform consumers about the personal information they collect and share, and gives consumers a right to access their information, request its deletion, and opt out of having it sold. Until January 1, 2021, employee personal information was outside the scope of most CCPA requirements, except for the right to know the categories and purposes of collection at or before the point of collection (§798.100(b)) and the right of private action in the event of a negligent data breach (§1798.150). This temporary exemption covers information collected in the course of the individual’s role as a job applicant, employee, officer, director, or contractor, used in that context — including emergency-contact and benefits-administration information, so long as it is used only for that purpose.

We collect information that identifies, relates to, describes, or could reasonably be linked with a consumer, device, or household (“personal information”). In the last twelve (12) months we have collected the following categories:

Personal information does not include publicly available information from government records, or de-identified or aggregated consumer information. We obtain the categories above from those same sources.

Use of personal information

We may use or disclose the personal information we collect for one or more of the following business purposes: to evaluate an employment application; determine eligibility for employment; administer pay and benefits; process employee work-related claims; establish training and development requirements; conduct performance and goal reviews; assess qualifications for a job or task; gather evidence for disciplinary action or termination; establish an emergency contact; report on company metrics; compile directories; comply with applicable labor or employment statutes; ensure the security of company-held information; and other purposes as reasonably required.

We will not collect additional categories of personal information, or use the information we collected for materially different, unrelated, or incompatible purposes, without providing you notice. We do not and will not sell your personal information, so we do not offer an opt-out to the sale of personal information.

Sharing personal information

We may share your personal information solely for a business purpose. When we do, we enter a contract that describes the purpose and requires the recipient to keep the information confidential and not use it for any purpose except performing the contract. In the preceding twelve (12) months, we have disclosed the following categories for a business purpose: A (Identifiers), B (CA Customer Records), C (Protected classifications), F (Network activity), G (Geolocation), and I (Employment info). We disclose personal information for a business purpose to the following categories of third parties: service providers. In the preceding twelve (12) months, we have not sold or leased any personal information.

Changes to our CCPA notice

We reserve the right to amend this privacy notice at our discretion and at any time. When we make material changes, we will post the updated notice in the TemPositions EWA, update the notice’s Effective Date above, and request employee acknowledgment by electronic review and sign-off.
